User Agreement
1. PARTIES
This User Agreement is entered into by and between Hop Teknoloji A.Ş. (hereinafter referred to as "Hop") (MERSIS NO: 0463108096300001) (Tax Identification Number: 4631080963) (Authorization Certificate No: BKN.E-S.1080440.1) and the individual who accepts/approves this agreement through the application (hereinafter referred to as "User").
2. DEFINITIONS

VEHICLE: Provided that the conditions specified in hereby Agreement are complied with; electric scooter type vehicles that are supplied and brought into use in advance.

RIDE: Covers the period starting when the user unlocks the Vehicle via the mobile application and ending when it is locked again through the mobile application.

GROUP RIDE: A feature that allows more than one vehicle to be used under the account of a single user using one scooter.

AGREEMENT: This Vehicle Rental User Agreement.

DISTANCE FEE: The fee that the user is required to pay, calculated on a per-minute basis by the hop tracking system based on the distance covered with the vehicle during the usage period.

TARIFF: The fee structure determined by hop, which includes an unlocking fee and a per-minute usage fee, as specified in the hop application.

PERSONAL DATA: Data related to an identified or identifiable natural person, as defined under Law No. 6698 on the Protection of Personal Data.

APPLICATION: The hop mobile application.

WEBSITE: The website www.hoplagit.com.
-
RENTAL PERIOD: The rental period of the vehicles.

USER: The person who wishes to benefit from the services provided by hop, as described in this agreement, and who initiates a rental through the application.
3. SUBJECT
The subject of this Agreement is; fulfillment of the rental vehicle services by Hop which will be requested by the User during the period the contract is in force and the forms and conditions of the rental payment and the other fees to be made by the User and also determination of the mutual rights and responsibilities.
4. MEMBERSHIP
4.1.By completing the registration process after fulfilling the membership procedure
determined by Hop in the Application, the person wishing to be a User, completes the membership.
After the registration, the User also approves and accepts the provisions of this Agreement and all
kinds of statements announced/to be announced by Hop regarding membership and rental
conditions..
4.2. The User declares and guarantees that the personal information provided during
the membership process, such as name, surname, date of birth, national identification number,
address, email, and contact information, is accurate and complete, and that any changes in this
information will be immediately updated through the Application. The User acknowledges that they are
solely responsible for any legal disputes and damages arising from incomplete, outdated, or
incorrect information. No liability can be attributed to Hop for this reason. hop reserves the right
to suspend, block, or temporarily deactivate the user if there is any doubt regarding the accuracy
or currency of the provided information.
4.3. In order to get rental service from Hop, the User must be over 15 years old, approve this Agreement through the application and accept all terms of it. Users accept that; they will fulfill all of the membership conditions; if the membership conditions are not fulfilled, their membership can be terminated by Hop unilaterally at once, without any compensation and notification, and that the membership cannot be transferred.
4.4. In the event of unilateral termination of this Agreement by Hop, the termination shall not be interpreted as Hop waiving its right to compensation for damages.
4.5. The User acknowledges and agrees that the information provided during the membership phase will be recorded and stored in the system, the driver's license conditions must meet the rental conditions stated in the Application, the User must be at least 15 years old, the activation and operation of the system through a mobile phone requires the phone used during registration to be present and operational during rental, pickup, and termination of the rental, and the vehicle must be securely locked with a stand lock and locked to a fixed point in a manner that does not obstruct sidewalks, bus stops, pedestrian, disabled and access paths, property entrances/exits, or traffic flow. In the event of failure to end the rental for any reason, the User must immediately notify Hop Customer Services and agrees not to rent the vehicle if these conditions are not met.
5. RENTING
5.1. In order to rent the vehicles of Hop, the User is obliged to select the vehicle and make the rental request through the Application.
5.2. hop is authorized to request a copy of the USER’s driving license or identity card with the ID number, which is issued in the name of the USER and its validity is declared and committed by him/her. hop has the right to obtain information about the USER by applying to relevant institutions with the aim of checking the accuracy of the USER’s personal information and documents.If the User does not provide the aforementioned documents, Hop will not proceed with the rental.
5.3. The user accepts responsibility for all transactions performed through the Application and any actions taken using the email address and mobile phone number provided to hop. The user confirms that these transactions are conducted with their full consent. Once the user gains physical access to the vehicle and establishes communication with it through the Application on their mobile phone, the vehicle is considered rented. The user is fully responsible for all actions taken through the Application, including canceling a rental request, reporting any defects or malfunctions with the vehicle, and starting the vehicle. The user is also accountable for all communications made using the email address and mobile phone number provided to hop. hop’s records will be deemed valid for all transactions carried out through the Application, and the user irrevocably accepts all records and documents generated by hop.
5.4. The user is solely responsible for all terms and conditions set forth in this Agreement. The vehicle rented through the user’s account in the Application may only be used by the user. If it is determined that the vehicle is being used by someone other than the user, hop reserves the right to suspend, block, or terminate the relevant user.
6. FEES
6.1. The opening fee and distance fee applicable to vehicle rentals are the rates announced by hop in the Application. These rates may be subject to change. hop reserves the right to modify or cancel the announced rates at its sole discretion without requiring any prior notice or permission, provided such changes are made before the relevant rental begins. The user hereby accepts in advance any new rates and pricing that will be announced in the Application. The user also acknowledges that the fee schedule may vary depending on their location and/or the rented vehicle.
6.2. Rental fees are calculated based on the duration of the rental. This fee starts when the Vehicle is unlocked via the mobile application and continues until the ride is ended through the mobile application. hop’s records regarding the rental duration are considered valid and will be used as the basis for all calculations.
6.3. hop may, at its sole discretion, create or assign “Promotion Codes” that may offer discounts or benefits related to the provided services or other features, subject to additional terms and conditions set by hop. These promotion codes may be limited to specific locations, time periods, or other conditions.Promotion codes are offers that can be used exclusively through the application, are limited in quantity as determined by hop, and are personal to the user. The user may not copy, sell, or transfer promotion codes in any way. Promotion codes may be offered to all users or only to specific users who meet certain criteria. These codes have no cash value, cannot be combined with other offers, and must be used strictly according to the terms specified. hop reserves the right, without any obligation, to update, modify, or completely cancel/void any promotion codes at any time and for any reason.
7. PAYMENT
7.1. The user agrees to pay the rental fees for all rentals carried out under this Agreement, as well as traffic fines, damage/repair costs resulting from the use of the scooter, parking and towing fees, service fees, damages arising from breaches of this Agreement and/or legal regulations, repair costs, loss of revenue, operational expenses, penalties stipulated in Article 16 titled "Penalties" of this Agreement, and any other damages or expenses incurred in favor of third parties, including material and moral compensation. The user also agrees to pay all other amounts arising from this Agreement and the rental process, including any taxes, fees, and expenses that hop is required to pay due to the Agreement or as a result of the user’s breach or fault.
7.2. The user will make payments for rentals through a valid credit card or prepaid card registered in the Application, or through similar payment methods approved by hop. The user is required to register a valid credit card, prepaid card, or similar payment method in the Application. It is not possible to delete any registered credit card, bank card, prepaid card, public transportation card, or similar payment method from the system without first registering a new one. hop does not store any payment information in its own database. All payment details are stored in payment systems that the user independently authorizes. hop assumes no responsibility in cases of card theft.
7.3. The user acknowledges and agrees that, in the event of any outstanding debt and/or penalty (including those mentioned in Article 17), hop may directly charge the registered credit card, bank card, or prepaid card for the owed amount(s) without prior notice. By starting to use the services, the user expressly consents to this process. If the payment cannot be processed due to issues with the credit card or prepaid card (such as insufficient funds), the user will be required to top up the card or register another card with sufficient funds to complete the payment. If the user refuses to pay any rental fees, outstanding debts, or penalties related to the rental, hop reserves the right to suspend or cancel the user's account and reject any further rental requests. hop also reserves the right to pursue all legal remedies in addition to the collection methods specified in this Agreement.
7.4. Without prejudice to other provisions of this Agreement, hop reserves the right to seek recourse from the user for any payments it is required to make to third parties under any name or title. The user agrees and undertakes to pay such amounts upon hop’s first request, without the need for any formal notice.
8. GROUP RIDE
8.1. A Group Ride allows multiple Vehicles to be used simultaneously by different users, initiated through the user's own account. The Group Ride ends only after all Vehicles are properly parked and photos of the parked vehicles are uploaded to the system via the application.
8.2. If the user initiates a Group Ride through the application, they accept and undertake that each participant in the Group Ride will comply with all the terms and conditions of this Agreement.
8.3. The user must be at least 18 years old to initiate a Group Ride. The user also agrees and confirms that all drivers participating in the Group Ride through their account are at least 15 years old and will provide accurate and complete information, such as names and other required details, if requested.
8.4. Each Vehicle included in the Group Ride will be billed separately, starting from the moment its ride begins. The user who initiates the Group Ride is responsible for all opening and per-minute fees of the rented Vehicles and any payments or damages arising from the use of these Vehicles under this Agreement and applicable laws. The user agrees and undertakes to cover all charges incurred due to the use of the Vehicles by drivers participating in the Group Ride.
8.5. The user also acknowledges and agrees that if they violate any of the conditions set forth in this section regarding the Group Ride, hop may restrict or disable the user’s ability to use the Group Ride feature.
9. USAGE OF THE VEHICLE AND RESPONSIBILITIES
9.1. The user agrees to use the rented vehicle in accordance with the rules outlined in the Electric Scooter Regulation No. 31454, Law No. 2918, and other relevant legislation. The user also acknowledges that they cannot use the services if they are under the age of 15, even with parental or guardian consent. Additionally, the user is responsible for keeping up to date with applicable laws and cannot use ignorance of the law as an excuse.
9.2. By starting the rental, the user agrees to use the Vehicle in accordance with the terms and conditions of this Agreement, to pay the rental fees and any other charges (including VAT) outlined in this Agreement, and to return the Vehicle in a complete, undamaged state by properly ending the rental through the Application.
9.3. Except for the Group Ride feature that allows multiple users to ride vehicles, only the user who initiated the rental may use the Vehicle. No other individual is permitted to use the Vehicle under any circumstances.
9.4. The user is prohibited from carrying other people or loads (apart from personal items carried on their person) while using the Vehicle. The user is solely responsible for any damage, malfunction, or cost resulting from violations of these rules. hop reserves the right to seek reimbursement from the user for any related costs and may charge the user’s registered payment methods (credit card, bank card, prepaid card, public transportation card, or similar) without prior notice.
9.5. The user agrees to comply with all legal regulations, the terms outlined in this Agreement, and the instructions provided in the Application regarding vehicle use. Before starting a ride, the user is required to visually inspect the Vehicle (including its battery level, condition, tires, mudguards, lights, and brakes) and report any damage to hop immediately. If any damage is detected, the user must not use the Vehicle and must end the rental if it has already begun. Failing to do so makes the user liable for any resulting damages.Throughout the ride (from start to finish), the user agrees to use the Vehicle properly and is responsible for the safety of any external devices or personal belongings they carry.
9.6. The user acknowledges that they are solely responsible for any accidents or damage resulting from interactions with motorized/non-motorized vehicles, pedestrians, traffic, road conditions, weather, or other risks encountered during use.
The user agrees to use the Vehicle only within designated areas, following the safety measures outlined in the relevant regulations and the Application. The user also agrees not to end the ride in areas where parking is prohibited and not to use the Vehicle in restricted areas. If the user parks the Vehicle improperly (e.g., obstructing traffic, pedestrian paths, or private property) or if the Vehicle is stolen, the user is fully responsible for any resulting damage or liabilities to hop or third parties. hop reserves the right to charge the user’s registered payment method for any related costs.
9.7. It is strictly prohibited to use the vehicle especially (but not limited to) for the following purposes and the USER will be solely responsible for any behavior contrary to this:

Transporting goods prohibited under customs regulations or other laws.

Engaging in illegal activities.
-
Carrying the Vehicle on public transportation or private vehicles.
-
Towing or pushing another object.
-
Using the Vehicle for commercial purposes (e.g., transporting passengers or goods for profit).
-
Overloading the Vehicle with heavy items.
-
Operating the Vehicle under the influence of drugs or alcohol.
-
Participating in races or competitions.
-
Riding on unsuitable terrain (e.g., sand, mountains, riverbeds, swamps) or roads that exceed the Vehicle’s technical capacity.
-
Using the Vehicle without proper safety gear (e.g., helmet, knee pads, elbow pads).
-
Violating traffic regulations outlined in Law No. 2918 on Road Traffic.
9.8. The user is prohibited from subleasing, selling, or transferring the rented Vehicle or services to third parties. The Vehicle may not be used for commercial purposes (e.g., advertising, food delivery, ride-sharing).
hop reserves the right to seek reimbursement from the user for any damages resulting from improper use. If the Vehicle is used in violation of Law No. 2918, legal action may be taken against the user, and hop may charge the user’s registered payment method for any resulting costs.
9.9. The user agrees not to tamper with or modify the Vehicle or its components (including labels) without hop’s written consent. Any unauthorized modifications or damages will make the user responsible for all repair costs. hop may unilaterally terminate this Agreement and pursue legal action if misuse is detected.
9.10. The user is responsible for any mechanical or electrical damage caused by misuse, negligence, or improper handling of the Vehicle.
9.11. If the user deletes or invalidates their registered payment method (credit card, bank card, prepaid card, public transportation card, etc.) during the rental, or if hop determines that the payment method is insufficient or unauthorized, hop reserves the right to immediately repossess the Vehicle without prior notice or permission. The user agrees not to hold hop liable for ending the rental in such cases.
9.12. In the event of an accident, regardless of whether the user followed safety protocols, hop will not be held liable for any damages, injuries, or losses, except in cases of technical failure. The user assumes full responsibility for any legal claims, damages, or costs arising from accidents, including attorney fees and court costs.
The user must immediately report any accidents, collisions, damage, injuries, theft, or loss of the Vehicle to hop and the relevant authorities. If the user fails to report such incidents and this results in legal or financial consequences, the user will be fully responsible for any related costs.
In the case of a Group Ride, the user agrees to be jointly and severally liable with the participating drivers for any fines, damages, or claims, even if they were not directly at fault.
9.13. The user is responsible for protecting the Vehicle and its components during the rental. In the event of theft, damage, or loss, the user must immediately report the incident to the appropriate authorities and provide hop with official documentation.
9.14. The user acknowledges that hop is not responsible for any loss, theft, or damage to personal items carried on or left in the Vehicle during the rental.
9.15. The user accepts and undertakes that, during the rental period, they shall be liable for any damages, material and moral compensation, and similar expenses that may arise against third parties. hop reserves its right of recourse against the user for any amounts it may be required to pay for this reason. hop further reserves the right to collect these amounts through the credit card, bank card, or prepaid card registered on the Application, and the user has accepted and consented to this condition in advance.
9.16. Even after the termination of this Agreement, the user remains liable for any damages caused during the rental period due to negligence or improper use.
9.17. The user agrees, on their own initiative, to use the mobile device/item apparatus, phone holder, and similar equipment on the vehicle solely in accordance with its design and intended purpose. The proper use of these apparatuses and the secure placement of the device/items into the designated compartment to ensure the safety of the item is the responsibility of the user. Any damage or loss arising from the incorrect use of the vehicles or apparatuses, from assembly errors, or from the device not being securely placed; such as the damage, loss, or dropping of personal items like phone, wallet, key, bag, shoes, glasses, hearing aid, or similar, shall not be the responsibility of hop, and all responsibility shall belong to the user. The user agrees that they will not make any claim against hop due to such situations.
10. RETURN OF THE VEHICLE
10.1. The user agrees to return the Vehicle in the same condition as it was received, complete and without any damage. The user is responsible for any damage, loss, or deficiencies identified upon return that go beyond normal wear and tear and must immediately pay any costs determined by hop. hop also reserves the right to inspect the Vehicle after the return date and notify the user of any damages or deficiencies discovered later.
10.2. If the user fails to comply with any provision of this Agreement, especially by not returning the Vehicle at the end of the rental period, the user grants hop the right to reclaim and repossess the Vehicle immediately, wherever it may be, without prior notice, permission, or legal action. The user will be responsible for covering any costs or damages incurred during the retrieval or repossession of the Vehicle by hop.
10.3. When ending a rental, the user agrees to properly park the Vehicle by deploying the kickstand securely to prevent it from falling, locking the Vehicle to a fixed point using the onboard lock, and taking a clear photo of the parked Vehicle to confirm its return and the end of the rental. The rental will only be considered complete after these steps are followed.The user is responsible for ensuring the Vehicle is not parked in prohibited or obstructive locations, such as short poles, fire hydrants, bollards, medians, shutters, garbage containers, or pathways designated for disabled access. Locking the Vehicle inappropriately, such as locking it to itself, to another vehicle, or in a way that obstructs pedestrian or vehicle traffic, will be treated as if the Vehicle was left unlocked, and the user will be liable for any resulting damages or violations.
10.4. The maximum rental duration for all types of rides is 3 hours. The user must end the ride, including any Group Rides, before this maximum period expires. The user may start a new rental after properly ending the current one. If the user fails to end the ride before the maximum duration, hop reserves the right to terminate the ride remotely through the system. hop’s failure to exercise this right on time or at all does not exempt the user from paying for any overage or from fulfilling other contractual or legal obligations.
11. TERMINATION RIGHTS AND END OF THE AGREEMENT
11.1. Either party may terminate this Agreement at any time by providing written notice to the other party.
11.2. If the user fails to pay any amount due to hop in full and on time, violates any provision of this Agreement, abandons the Vehicle in any location, acts in a manner that raises suspicions of misuse, provides incorrect information or documents, or fails to comply with the terms of this Agreement and its rules, hop reserves the right to unilaterally and immediately terminate this Agreement without notice, warning, or the need for a legal ruling, and without any obligation to pay compensation.
11.3. Even if this Agreement is terminated for any reason, the user remains liable for any obligations arising from previous rides and usage under this Agreement. In this regard, the user agrees and undertakes that hop may pursue any outstanding debts or damages resulting from the user's use.
12. TRANSFER AND ASSIGNMENT
12.1. hop reserves the right to transfer and assign, partially or fully, its rights and obligations under this Agreement to any person or organization without obtaining the user's consent.
12.2. The user may not transfer or assign, in whole or in part, any of their rights or obligations under this Agreement without hop’s prior written consent.
13. PRIVACY POLICY AND PERSONAL DATA PROTECTION
13.1. hop processes users' personal data in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK"). In this regard, hop commits to protecting the Personal Data it has access to under this Agreement in compliance with all rules and obligations stipulated by Law No. 6698 and other applicable regulations. hop agrees and undertakes to adhere to all principles and obligations concerning the protection and processing of users' Personal Data and accepts full responsibility in the event of any violation.
13.2. Detailed information regarding the processing of personal data is provided in the Clarification Text and hop’s Personal Data Protection, Processing, and Privacy Policy. The user acknowledges having read these documents.
14. NON-EXCLUSIVITY
Nothing in this Agreement shall be construed as creating an exclusive relationship between the parties. Both parties acknowledge that the user has the right to obtain similar services from third parties.
15. AUTHORIZATION
Turkish Law shall govern the interpretation of this Agreement and any disputes arising from or related to this Agreement. The Ankara Central Courts and Ankara Central Enforcement Offices shall have exclusive jurisdiction over any disputes between the parties.
16. PENALTIES
16.1. The user agrees that, in addition to hop’s right to terminate this Agreement, claim actual damages, or exercise any other rights provided under this Agreement, hop may impose the following penalties even if no direct damage has occurred:

Up to 1,100 TL for violating Article 9.3 (allowing someone else to use the Vehicle outside of Group Ride).

Up to 1,100 TL for violating Article 9.7 (using the Vehicle outside the service area).
-
Up to 1,100 TL for violating Article 9.8 (using the Vehicle for inappropriate purposes).
-
Up to 1,100 TL for violating Article 9.2 (leaving the Vehicle outside the service area).
-
Up to 12,000 TL for violating Article 9.9 (making unauthorized modifications).
-
Up to 18,000 TL for violating Article 9.9 (damaging the tracking and security system).
-
Up to 18,000 TL for violating Article 9.10 (damaging the Vehicle).
-
Up to 18,000 TL for violating Article 9.11 (using an unauthorized credit card).
-
Up to 60,000 TL for violating Article 9.13 (causing the Vehicle to become out of service).
Additional penalties include:
-
A fee of up to 600 TL per instance if hop needs to relocate the Vehicle to a proper parking spot.
-
A fee of up to 4,000 TL for improper parking that violates local parking rules.
-
A fee of up to 1,100 TL for taking the Vehicle onto public transportation.
16.2. The user agrees and gives prior consent for hop to charge the above-mentioned penalties directly to the user’s registered payment methods (credit card, bank card, prepaid card, public transportation card, or similar) without the need for prior notice.
17. PROPERTY RIGHTS
17.1. The user does not have the right to use hop’s registered trademark and logo; ownership of the trademark and logo belongs to hop, and unauthorized use is strictly prohibited. All rights related to hop’s trademark are reserved.
17.2. hop’s website, Application, advertising materials, and other written or visual content are the property of hop. Unauthorized use of this content is prohibited.
17.3. It is forbidden to copy, modify, or reverse-engineer the Application developed by hop for commercial or other purposes. The user agrees and undertakes that hop will not be held liable for any disputes or damages arising from such actions.
17.4. The user agrees and undertakes to be responsible for any damages incurred by hop due to violations of this clause.
18. EVIDENCE AGREEMENT
The parties agree, declare, and undertake that in any dispute arising from this Agreement, Hop's commercial books and records, information in its database, electronic and system records, correspondences in instant messaging applications, emails, and social media correspondences shall be considered binding, exclusive, and conclusive evidence under the evidentiary agreement.
19. SERVICE PERFORMANCE AND FORCE MAJEURE
hop will make every effort to provide uninterrupted service. However, in the event of force majeure or unforeseen circumstances, such as natural disasters, floods, fires, storms, power outages, connection issues, changes in legal regulations, or administrative measures taken during national or religious holidays, hop cannot guarantee the continuity of the service.
hop will strive to ensure that the Vehicles and services are available but does not guarantee that they will always be accessible.
hop reserves the right to reclaim any Vehicle being used by the user at any time.
20. OTHER PROVISIONS
20.1. The parties accept, declare and undertake that; the addresses written in this Agreement are their legal notification addresses and unless the address change is notified in writing to the other party within three (3) days, the notifications to be sent to these addresses will cause all legal consequences of the valid notification.
20.2. The parties’ failure to exercise or delay in exercising any right or power given in this Agreement does not mean an abandonment of aforesaid right or power and the single or partial use of a right or power does not prevent the subsequent exercising of that or any other right or power.
20.3. If consent is obtained from the Users, Hop retains the unilateral right to issue an insurance policy for any personal life dangers occurring due to the use of services provided under this Agreement and for any type of damages that may be inflicted on real and/or legal persons during driving.
20.4. Should any provision of this Agreement be deemed invalid or unenforceable for any reason, the other provisions of the Agreement shall remain in effect.
20.5. All terms of this Agreement have been accepted by the User through electronic approval.
20.6. Hop, at its sole discretion, may unilaterally make changes, amendments, and improvements to this Agreement without seeking the consent of the User. Should any changes be made to the Agreement, Hop will publish the updated Agreement, which will be effective and in force from that moment onward. All existing and new Users will be subject to the terms and conditions of the updated Agreement. Continued access to and use of the services by the User after changes to the Agreement implies acceptance of the revised terms.
